Please read these Terms of Service ("Terms") carefully before using FleetIQ ("Service"), a fleet management platform operated by Veritas Data LLC ("Company," "we," "us," or "our"), a Florida limited liability company. By accessing or using the Service, you agree to be bound by these Terms.
By creating an account, accessing the Service, or clicking "I Agree," you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity ("Organization"), you represent that you have authority to bind that Organization. If you do not have such authority, or do not agree to these Terms, you may not use the Service.
These Terms constitute a binding agreement between you (or your Organization) and Veritas Data LLC. Use of the Service via the AWS Marketplace is also subject to the AWS Marketplace Terms of Service.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
The Service is provided on a multi-tenant basis. Each Organization ("Tenant") has a logically isolated environment. You may not attempt to access data belonging to other Tenants.
Administrators may create and manage sub-accounts for managers, drivers, and viewers within their Tenant. Administrators are responsible for ensuring all users under their account comply with these Terms.
You agree to notify us immediately at support@veritas-data.io of any unauthorized use of your account. We are not liable for losses resulting from unauthorized use of your credentials.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate this section without prior notice.
You retain all ownership rights to data you submit to the Service ("Customer Data"), including vehicle records, driver information, inspection reports, and work orders. We do not claim ownership over Customer Data.
You grant us a limited, non-exclusive license to store, process, and transmit Customer Data solely to provide and improve the Service and as described in our Privacy Policy.
You are solely responsible for the accuracy, quality, and legality of Customer Data. We are not responsible for errors or issues arising from inaccurate or incomplete data.
Upon termination of your account, we will retain your Customer Data for 30 days, during which you may request an export. After 30 days, we may delete your data in accordance with our data retention policies.
If you connect the Service to third-party platforms (e.g., Geotab, Samsara), you authorize us to exchange data with those platforms on your behalf. You are responsible for ensuring you have the right to share such data.
Subscription fees are based on your selected plan and the number of vehicles or users, as described at the time of purchase. Fees are billed in advance on a monthly or annual basis depending on your subscription.
If you subscribe to the Service through the AWS Marketplace, billing is handled by Amazon Web Services, Inc. and subject to the AWS Customer Agreement and applicable Marketplace terms.
You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities. We will charge sales tax where required by law.
Except as required by law or at our sole discretion, subscription fees are non-refundable. If you cancel mid-period, you will retain access through the end of the paid billing period.
We may change our pricing with at least 30 days' written notice. Continued use of the Service after the effective date constitutes acceptance of the new pricing.
The Service, including all software, algorithms, user interfaces, documentation, branding, and underlying technology, is the exclusive property of Veritas Data LLC and its licensors. These Terms do not grant you any rights to our intellectual property except the limited license to use the Service as described herein.
If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a royalty-free, perpetual, irrevocable license to use and incorporate that Feedback into the Service without any obligation to you.
Each party agrees to keep confidential any non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential ("Confidential Information"). Each party agrees to use Confidential Information only to perform its obligations under these Terms and to protect it with at least the same degree of care it uses for its own confidential information, but no less than reasonable care.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VERITAS DATA LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.
FleetIQ is a fleet management tool. It is not a substitute for professional safety inspections, regulatory compliance programs, or legal advice. You are solely responsible for ensuring your fleet operations comply with all applicable laws and regulations, including but not limited to FMCSA, DOT, and state vehicle safety requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VERITAS DATA LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Veritas Data LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any Customer Data you submit to the Service.
You may cancel your subscription at any time through your account settings or by contacting us at support@veritas-data.io. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms, fail to pay fees, or if we are required to do so by law. We may also terminate your account with 30 days' notice for any other reason.
Upon termination, your right to use the Service ceases immediately. Sections 5.1, 7, 9, 10, 11, and 14 survive termination.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
For disputes arising from AWS Marketplace subscriptions, additional dispute resolution terms from AWS may apply.
